Terms of Use

These terms govern your use of the FaydabulCloud platform. By creating an account or using the service, you agree to these terms.

1. Definitions

"Platform" refers to the FaydabulCloud deploy platform, AI Gateway, and all related services provided through faydabul.cloud and its subdomains. "We," "us," "our" refers to Faydabul Bilişim Teknolojileri, registered at Sancak Mahallesi 1609 Nolu Sokak 11/F Yomra Trabzon, Türkiye. "You," "user" refers to the individual or organization creating an account or using the platform. "Project" means a deployable application configured within the platform. "Content" includes source code, environment variables, application data, and any material you upload, deploy, or transmit through the platform.

2. Service Scope and Product Phases

FaydabulCloud is a full-stack deploy and AI operations platform designed for developer teams in Türkiye. V1 scope includes: GitHub repository connection, automated builds and deployments, custom domain management with automatic SSL, build and runtime log viewing, basic environment variable management, AI Gateway for tracking external model usage, and TL-based billing. Planned future phases (V2–V4) include managed databases (PostgreSQL, Redis), n8n hosting, team management with role-based access, Agent Runtime, Vector Database, multi-region deployment, and object storage. Features marked as planned are not guaranteed and may change based on user feedback and market conditions. During early access, certain features may be limited, unavailable, or subject to change without prior notice. We describe what is currently available, what is planned, and what is experimental transparently.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you register using Google or GitHub OAuth, you authorize us to access your name and email address from those providers. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that provide false information, violate these terms, or remain inactive for an extended period.

4. Pricing and Payment

FaydabulCloud offers plans denominated in Turkish Lira (TL). Available plans include Free (limited to one project), Starter, Pro, Agency, Business, and Enterprise tiers. Each plan includes defined limits for projects, build minutes, AI tokens, log retention, and team members. Pricing is published on our pricing page. During early access, plan limits and usage metrics are being validated and may be adjusted. Once commercial plans are finalized, payment will be collected monthly through our payment processor. You are responsible for all charges incurred under your account. Usage over plan limits may result in throttling or overage charges as described in your plan terms. We do not charge per seat — pricing is based on workspace resources and usage.

5. Acceptable Use

You agree not to use the platform for: (a) hosting, deploying, or transmitting content that is illegal under Turkish law, infringes intellectual property rights, or promotes violence, hate speech, or discrimination; (b) cryptocurrency mining, unauthorized network scanning, denial-of-service attacks, or any activity that disrupts the platform or other users; (c) sending unsolicited bulk messages (spam), phishing, or distributing malware; (d) attempting to circumvent usage limits, quotas, or billing mechanisms; (e) using the AI Gateway to generate content that violates the acceptable use policies of the underlying model providers. We reserve the right to remove content, suspend projects, or terminate accounts that violate these terms without prior notice.

6. Content and Intellectual Property

You retain all intellectual property rights in the content you deploy on the platform. By using the platform, you grant us a limited license to host, run, and display your content solely as necessary to provide the service. We do not claim ownership of your source code, applications, or data. You are responsible for ensuring that you have all necessary rights and licenses for the content you deploy. If we receive a valid notice of intellectual property infringement, we may remove or disable access to the allegedly infringing content.

7. Third-Party Integrations

The platform integrates with third-party services including GitHub (for repository access and deployment triggers), external AI model providers (OpenAI, Anthropic, Google, Mistral, DeepSeek, and others via AI Gateway), and a PCI-compliant payment processor. When you connect these services, you are also subject to their respective terms and policies. We are not responsible for the availability, accuracy, or data practices of third-party services. If a third-party service discontinues or changes its API, related platform features may be affected.

8. Platform Provider Obligations (Law No. 5651)

Under Turkish Law No. 5651 on the Regulation of Internet Publications and Combating Crimes Committed Through These Publications, FaydabulCloud may act as a hosting provider with respect to content you deploy. As required by law, we maintain traffic logs for the period prescribed by regulation and may be required to provide these logs to authorized authorities upon lawful request. We are not obligated to monitor content you deploy, but we reserve the right to take action if we become aware of illegal content or receive a valid legal notice. You acknowledge that as the content provider, you bear primary responsibility for the legality of your deployed content under 5651.

9. KVKK Disclosure — Personal Data Processing in Service Provision

In accordance with the Personal Data Protection Law No. 6698 ("KVKK"), Faydabul Bilişim Teknolojileri, registered at Sancak Mahallesi 1609 Nolu Sokak 11/F Yomra Trabzon, Türkiye, acts as data controller for the personal data processed through the platform. Processed data categories: identity (name, surname), contact (email), authentication data (OAuth tokens, session identifiers), platform usage data (project names, repository metadata, deployment configurations, environment variable keys, domain names, SSL status, build and runtime logs), payment data (billing address, TL-based payment information processed through a PCI-compliant provider; full card numbers are not stored), and AI Gateway metadata (request count, token consumption, model identifier, timestamp). Legal bases under KVKK Article 5: performance of the service contract, compliance with legal obligations under Law No. 5651 and tax legislation, our legitimate interest in platform security and abuse prevention, and your explicit consent for optional features such as marketing. Data may be transferred to: GitHub (USA) for repository access on your behalf; external AI model providers (OpenAI, Anthropic, Google, Mistral, DeepSeek, and others) for AI Gateway routing; a payment service provider for billing; and authorized public institutions upon lawful request. Cross-border transfers comply with KVKK Article 9 through adequacy decisions, standard contractual clauses (with notification to the KVKK Authority within five business days), binding corporate rules, or your explicit consent. Our primary infrastructure is in Türkiye; Control Plane metadata, project data, and deployment logs remain in Türkiye. Data retention periods: account data for the account lifecycle plus a reasonable post-deletion period; build and runtime logs per plan tier limits; AI Gateway metadata for the account lifecycle; commercial books and invoices for 10 years under Turkish law; traffic logs per Law No. 5651 regulation. We implement KVKK Article 12 technical and administrative measures including TLS encryption, encryption at rest, access controls, CSRF protection, and secure session cookies. Your KVKK Article 11 rights — including access, correction, deletion, objection to automated decisions, and compensation — may be exercised by contacting us at hello@faydabul.com. 10. Service Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. During early access, planned maintenance, infrastructure changes, and unexpected outages may occur. We will communicate scheduled maintenance through appropriate channels. Support is provided through the contact methods listed on our website. Priority support is available on Pro, Agency, Business, and Enterprise plans. Enterprise plans include a dedicated support SLA with defined response times.

11. Limitation of Liability

To the maximum extent permitted by Turkish law, FaydabulCloud is provided "as is" without warranties of any kind, express or implied. We are not liable for: (a) indirect, incidental, special, or consequential damages; (b) loss of data, revenue, profits, or business opportunities arising from your use or inability to use the platform; (c) damages resulting from third-party services integrated with the platform; (d) content you deploy or data you transmit through the platform. Our aggregate liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded under applicable mandatory law.

12. Termination

You may stop using the platform and delete your account at any time through the dashboard settings. We may suspend or terminate your account with 30 days' notice for any reason, or immediately if you breach these terms, engage in illegal activity, or if required by law. Upon termination, your right to access the platform ceases. We will delete your personal data in accordance with our Privacy Policy and KVKK obligations. Project data and deployment history may be retained for a limited period to allow data export; after that period, data is permanently deleted.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Türkiye. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Trabzon, Türkiye. Before initiating formal legal proceedings, we encourage you to contact us to seek an amicable resolution. For consumer disputes, you may also apply to the Consumer Arbitration Committee within the applicable monetary limits.

14. Changes to These Terms

We may modify these terms as the product evolves or legal requirements change. Material changes will be communicated through the platform dashboard, email notification, or a notice on our website at least 15 days before they take effect. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you may terminate your account before the changes take effect.
